Terms of Service

1. Acceptance

These Terms of Service (“Terms”) govern your use of HeyAva, an AI voice assistant platform operated by Super Intellisense Technologies (“HeyAva,” “we,” “us,” “our”) based in Mohali, Punjab, India.

By creating an account, accessing the service, or clicking “I agree,” you confirm that you have read these Terms and our Privacy Policy and agree to be bound by them. If you do not agree, do not use the service.

2. Who can use HeyAva

  • You must be at least 16 years old.
  • If you use HeyAva on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
  • You must provide accurate registration information and keep it up to date.
  • You may not use the service if you are located in a country subject to Indian government sanctions, or if you are on any restricted persons list.

3. Your account

You are responsible for safeguarding your password and for any activity that occurs under your account. Notify us immediately at hello@superintech.com if you believe your account has been compromised.

4. Plans, credits, and billing

4.1 Plans

HeyAva offers monthly and yearly subscription plans. Each plan includes a fixed number of monthly credits and specific features (integrations, memories, retention, seats). Prices are in Indian Rupees (INR) and exclusive of GST unless stated otherwise.

4.2 Credits

Voice and text requests to Ava consume credits based on the underlying AI model (e.g. 5 credits per Sonnet request, 15 per Opus request, plus additional credits for tool invocations). Unused monthly credits roll over to the next period while your subscription remains active (fair use: rollover is capped at two cycles of your plan allowance).

4.3 Credit packs

You can purchase additional credit packs at any time. Credit packs are one-time purchases and do not expire while your account is active.

4.4 Billing & renewal

Subscriptions auto-renew at the end of each billing period using Razorpay until you cancel. You authorise us to charge the payment method on file. Failed payments may result in suspended access.

4.5 Taxes

Prices shown exclude applicable Goods and Services Tax (GST), which will be added at the current statutory rate (18% as of the effective date).

4.6 Refunds

Subscription fees are non-refundable except where required by law. Credit pack purchases are non-refundable once redeemed. If you believe you have been billed in error, contact us within 7 days of the charge and we will review.

4.7 Cancellation

You can cancel your subscription anytime from the billing page. You retain access until the end of the current billing period. Cancelling does not refund unused portions of the current period.

4.8 Price changes

We may change pricing for future billing periods with at least 30 days' notice via email. Existing subscribers are billed at the price in effect when they subscribed until their next renewal.

5. Acceptable use

You agree not to:

  • Use HeyAva to violate any law, infringe any third party's rights, or distribute malicious content.
  • Attempt to reverse-engineer, decompile, or access non-public parts of the service.
  • Use the service to generate spam, phishing content, harassment, or content that violates the terms of third-party platforms you connect (e.g. sending spam via your connected Gmail).
  • Scrape or bulk-download other users' data, or probe the service for vulnerabilities without our written permission.
  • Resell or sublicense the service without a written commercial agreement with us.
  • Use the service to process data you are not legally entitled to process, including personal information of third parties without their consent.
  • Use any automated means to exceed the credit allowance on your plan.

Violations may result in suspension or termination of your account without refund.

6. AI-generated content

HeyAva uses third-party AI models (Claude from Anthropic, Whisper from OpenAI, and ElevenLabs for voice synthesis) to generate responses. AI-generated content may be inaccurate, incomplete, or unsuitable for your purpose. You should review AI outputs before acting on them, especially for decisions with financial, legal, medical, or safety implications.

Outputs Ava generates for you belong to you, subject to the underlying model providers' usage policies. You are responsible for ensuring outputs do not infringe third-party rights before using them.

7. Your content

You retain ownership of everything you send to HeyAva (voice inputs, transcripts, memories, documents). You grant us a limited, worldwide, non-exclusive licence to process your content solely for the purpose of providing the service (passing it to the AI models, storing conversation history, executing integrations you request).

We do not use your content to train generalised AI models. Our use of Google user data is further limited by the Google API Services User Data Policy (see our Privacy Policy).

8. Third-party integrations

HeyAva integrates with services such as Gmail, Google Calendar, WhatsApp, GoHighLevel, HubSpot, Slack, Notion, ClickUp, Monday, Stripe, Razorpay, and custom webhooks. When you connect an integration:

  • Your use of that third-party service remains subject to its own terms and privacy policy.
  • You authorise HeyAva to act on your behalf on that service to the extent of the permissions you granted.
  • You can revoke access at any time from HeyAva or directly from the third-party service.
  • We are not responsible for changes in or outages of third-party services.

9. Service availability

We aim to keep HeyAva available and reliable, but we do not guarantee uninterrupted service. We may perform maintenance, add or remove features, or suspend service for emergencies. We will give reasonable notice of planned downtime where practicable.

10. Disclaimers

Read this section carefully.

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the service will be error-free, secure, or accurate.

HeyAva is not a substitute for professional advice (legal, medical, financial, tax). Do not rely on AI-generated outputs for material decisions without independent verification.

11. Limitation of liability

To the maximum extent permitted by law, HeyAva and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the service.

Our aggregate liability for any claim arising out of these Terms or the service is limited to the greater of (a) the amounts you paid us in the 12 months preceding the claim, or (b) ₹ 10,000.

12. Indemnification

You agree to indemnify and hold harmless HeyAva and its affiliates from any claim, loss, or expense (including reasonable legal fees) arising out of your content, your violation of these Terms, your violation of applicable law, or your violation of any third party's rights.

13. Termination

You may terminate your account at any time from Settings. We may suspend or terminate your account if you materially breach these Terms or engage in conduct that harms the service or other users. Upon termination, your right to use HeyAva ends immediately; sections that by their nature should survive (intellectual property, liability limits, indemnification, disputes) will continue.

14. Governing law & disputes

These Terms are governed by the laws of India, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the service will be subject to the exclusive jurisdiction of the courts located in Mohali, Punjab, India.

15. Changes to these Terms

We may update these Terms as our service evolves. We will notify you of material changes by email or via the dashboard at least 15 days before the change takes effect. Continuing to use the service after a change takes effect constitutes acceptance of the updated Terms.
